Emissions history is market-specific, model-year-specific and engine-code-specific, and the legal side has kept moving for a decade. This article is orientation, not a ruling on your car. For any specific vehicle, the VIN and the manufacturer's own recall lookup are the only authority — everything below is the map, not the territory.
Two engines, one scandal, and a lot of confusion
In September 2015 the US EPA issued a notice of violation to Volkswagen. The engine involved was the EA189 2.0 TDI, and the mechanism was a defeat device: software that recognised the shape of an emissions test — steering wheel not moving, a specific drive pattern — and ran full emissions control only then. Off the test, it didn't. The number that went around the world was roughly 11 million vehicles.
The EA189's era was, broadly, 2009 to 2015. In Golf terms, that's the Mk5 and Mk6.
The EA288 is the engine that replaced it — and it arrived with the Mk7. So when someone tells you Mk7 TDIs are “the Dieselgate cars”, they are, in the great majority of cases, describing the wrong generation.

What the Mk7 actually has
Every Mk7 TDI — 1.6 and 2.0, from the 90 PS commuter to the 184 PS GTD — is EA288 family. It was a clean-sheet response to tightening standards: revised emissions hardware, different EGR architecture, different aftertreatment strategy.
That's the point most buyers miss. The Mk7 diesel isn't the scandal engine that got patched. It's the engine VW designed because the standards were tightening — and then, awkwardly, the scandal broke around its predecessor while it was already in showrooms.
The exception: the US, 2015
Here's where the neat story stops being neat, and it's the reason blanket statements about the EA288 are wrong.
In the United States, the 2015 model year vehicles with the EA288 — the Golf, Golf SportWagen, Jetta, Beetle and Passat of that year — were drawn into the emissions settlement as a separate, later-identified group, generally referred to as “Gen 3”. Their remedy was a software update, and by the standards of what EA189 owners went through it was a mild affair: no hardware, no dramatic driveability arguments, comparatively little noise.
So: if you're shopping in North America, the 2015 EA288 cars have a specific, documented emissions history and it's worth confirming the update status on the individual car. If you're shopping in Europe, this particular chapter isn't your chapter.
The thermal window — the argument that is about EA288
The genuinely live issue around the EA288 in Europe isn't a hidden test-detection device. It's the thermal window — Thermofenster, if you're reading German coverage.
The idea: exhaust gas recirculation is reduced or disabled outside a range of ambient temperatures. The manufacturers' justification is engine protection — cold EGR promotes condensation, soot and deposits, and running full EGR at low temperatures shortens component life. The counter-argument is that if your emissions control is switched down for a large share of real European driving days, calling it engine protection is doing a lot of work.
This has been in and out of German courts for years, it isn't unique to Volkswagen — thermal windows were an industry-wide practice — and it has produced rulings rather than a single verdict.
What matters for a buyer is what this isn't: it isn't a mechanical fault, it doesn't affect how the car drives, and it isn't something you can inspect for on a driveway. It's a legal and regulatory question about a car you'd otherwise consider entirely normal.
What the fix did to driveability — the story you've heard
The EA189 fix generated a very large body of owner complaint: reduced power, worse economy, and above all a widespread conviction that EGR valves and DPFs started failing more often afterwards. VW's position was that the update didn't cause those failures. Owners across several countries disagreed at volume, and in England and Wales the resulting group litigation — tens of thousands of claimants — settled in 2022 for £193 million, without any admission of liability.
You should know that story. You should also know it's mostly not a Mk7 story. It's a Mk6 story, and an early-Passat story, and it arrived in the Mk7's reputation by association — the badge on the boot said TDI, and 2015 was not a year in which anyone was in a mood to distinguish between engine families.
The post-fix driveability debate largely doesn't apply. The defeat device story largely doesn't apply outside US 2015 cars. What's left is a competent, efficient diesel with the ordinary concerns of any modern diesel — which is a much smaller and much more manageable list.
So what is left to worry about?
Take the scandal out and a Mk7 TDI's real risks are unglamorous and largely under your control:
- The DPF, and the life you'll give it. By far the biggest one, and it's about you, not the car. Short trips prevent regeneration; incomplete regeneration accumulates soot; soot that never burns becomes ash; ash never leaves. A 130,000-mile motorway TDI can be in better health than a 40,000-mile school-run TDI, and that sentence is the whole diesel buying guide.
- EGR wear. An EGR valve deliberately routes soot back through the intake. It gets dirty. This is the design working, not failing — but it's a wear item and on a high-mile car it may be near the end of its patience.
- Recall status. The EA288 has had recall activity in various markets over the years for reasons unrelated to the defeat device story. Check the specific VIN against the manufacturer's lookup for the market the car lives in. It's free.
- Where you're allowed to drive it. This is the risk that has grown fastest and gets modelled least. Low-emission and clean-air zones have expanded across European cities and continue to; a Euro 6 Mk7 TDI is compliant with most current schemes, but you are making a bet on the direction of policy for however long you keep the car.
Bargain or liability?
Both, depending entirely on the buyer — and the split isn't about the engine, it's about the mileage you do and where you do it.

Checking a specific car
Practical, in order:
- Scan it — DPF data specifically. Soot load, ash load, and distance since last regeneration. Ash load is the number that can't be undone; it's a straight readout of how the car has been used, and it doesn't lie the way an owner might.
- Run the VIN through the manufacturer's recall lookup for the right market. Free, definitive on what applies to this car.
- Ask the journey question, not the emissions question. “What was your commute?” tells you more about a diesel's health than any question about software ever will. A seller who says “mostly the M6” is selling you a healthier car than one who says “nursery run, four miles.”
- Don't over-index on the badge. A well-used Euro 6 EA288 with a clean scan and a motorway life is a good car. That's allowed to be the conclusion.
The Mk7 is not the Dieselgate Golf — that was the Mk6 and its EA189. The Mk7 has the successor engine, and outside the US 2015 cars, most of the fix-related horror stories simply aren't its inheritance.
What's left is an ordinary modern diesel question: do you drive far enough, often enough, to deserve one? If yes, it's the cheapest Mk7 to run by a comfortable margin. If no, no software update in history was going to save you from that — and you wanted a small petrol all along.
